Little Turns Terms of Use

These Terms of Use ("Terms") are an agreement between you and Rabbit Soft Szymon Krolikiewicz ("we", "us", "Little Turns"), a sole trader registered in Poland, European Union, email hello@littleturns.app. They govern your use of the Little Turns iPhone app ("the app"). By installing or using the app you agree to these Terms. If you do not agree, do not use the app.

Apple's standard Licensed Application End User License Agreement (EULA) also applies to the app as distributed through the App Store. Where these Terms and Apple's EULA differ, these Terms apply to the extent permitted, except that Apple's EULA governs the relationship with Apple.

1. What the app does

Little Turns listens through your iPhone's microphone during a session you start and counts conversational turns between an adult and a child, along with an approximate adult word count. Processing happens on the device. Audio is not recorded, stored or transmitted. The app shows you counts, history and simple insights to encourage back-and-forth conversation.

The app is a counting and motivation tool. It is not a medical device, a diagnostic tool, a speech or language assessment, a developmental screening tool, or a substitute for advice from a doctor, speech-language therapist, or other qualified professional. Counts are estimates and can be wrong. If you have concerns about your child's speech, hearing, language or development, consult a professional.

2. Who may use the app

You must be at least 18 years old, or the age of majority where you live, and the parent or legal guardian or an authorised caregiver of any child you use the app around. The app is for adults; it is not intended to be operated by children.

3. Your responsibilities when listening

The app processes live audio. You are responsible for using it lawfully and respectfully:

• Use the app only where you have the right to do so. In some places, processing other people's speech without telling them may be restricted. The app does not record, but you should still tell other adults present that the app is counting turns if they could reasonably expect otherwise.
• Do not use the app to monitor other people, including other adults, nannies, teachers or other children, without their knowledge and, where required, consent.
• Do not use the app in places where recording or audio processing is prohibited.
• Do not rely on the app for safety, supervision or monitoring of a child. It is not a baby monitor and will not alert you to anything.

4. Accuracy

Turn and word counts are estimates produced by on-device models. They are affected by noise, distance, overlapping speech, television, music, more than one child, and the voices involved. The app may count a turn that did not happen or miss one that did. We make no promise about accuracy for any particular situation. Do not use the counts to make decisions about a child's health, education or care.

5. Subscription, trial and payment

5.1 Free trial

New users get a free trial with full access; its length is shown in the App Store before you start it. No payment is taken during the trial. If you do not subscribe before the trial ends, the app switches to a limited mode: you can view your history but cannot start new sessions.

5.2 Plans

After the trial, the app requires an auto-renewing subscription, currently offered as a yearly plan (USD 29.99 a year) and a monthly plan (USD 4.99 a month). Prices in your local currency are shown in the App Store and in the app before you buy and may differ from the USD prices. Prices include applicable VAT where Apple collects it.

5.3 Billing

Payment is charged to your Apple Account when you confirm the purchase. The subscription renews automatically at the end of each period unless you cancel at least 24 hours before the renewal date. You manage and cancel your subscription in iPhone Settings > Apple Account > Subscriptions, or through the App Store. Deleting the app does not cancel a subscription.

5.4 Family Sharing

The subscription supports Apple Family Sharing. Family members use the app under their own Apple Accounts and these Terms apply to each of them.

5.5 Refunds

Purchases are made through Apple and refunds are handled by Apple under Apple's policies. We cannot issue refunds directly. You can request a refund at https://reportaproblem.apple.com.

5.6 Right of withdrawal (EU and UK consumers)

If you are a consumer in the European Union or United Kingdom, you may have a 14-day right of withdrawal for digital content and services. Apple handles the exercise of this right for App Store purchases. Where you give express consent to immediate access to the subscription and acknowledge that you lose the right of withdrawal, that consent is given to Apple through the App Store flow.

5.7 Price changes

We may change prices for new subscriptions at any time. For existing subscribers, Apple will notify you of a price increase in advance and, where required, ask for your consent before the new price applies.

5.8 Lapsed subscriptions

If a renewal payment fails, Apple may offer a grace period during which you keep access while the payment is retried. If the subscription lapses, the app switches to the limited mode described in 5.1. Your history is kept and becomes fully available again if you resubscribe.

6. Your data and privacy

Our Privacy Policy, available at https://littleturns.app/privacy and in the app, explains what the app does with information. In short: audio is processed on the device and discarded, session results are stored on your device only (and inside your iPhone's own iCloud Backup if you use one), and we collect nothing. You can export your session results as a CSV file and delete all data from within the app.

You are responsible for keeping your device and Apple Account secure and for backups of any data you care about. We cannot recover data that you delete or that is lost because of device loss, iCloud settings or Apple account issues.

7. Licence and acceptable use

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on Apple devices you own or control, as permitted by Apple's usage rules.

You agree not to:

• copy, modify, distribute, sell, rent or sublicense the app or any part of it;
• reverse engineer, decompile or attempt to extract the source code or models of the app, except to the extent the law expressly permits;
• remove or alter any notices in the app;
• use the app for any unlawful purpose, or to harm, monitor or harass anyone;
• interfere with the operation of the app or the App Store, or circumvent subscription checks.

The app, its design, text, graphics, sounds, models and code are owned by us or our licensors and are protected by copyright and other laws. The app includes open-source components used under their licences; a list is shown in the app under Settings > About.

8. Updates and changes

We may update the app, add or remove features, or stop offering it. We will try to give notice of material changes to a subscription, and Apple's rules on subscriptions and refunds apply if we withdraw the app. The app may require a minimum iOS version; older devices may stop being supported.

We may change these Terms. The current version is always at https://littleturns.app/terms. If we make changes that matter, we will show a notice in the app before they take effect. Continued use after the effective date means you accept the changed Terms. If you do not accept them, stop using the app and cancel your subscription.

9. Disclaimer of warranties

To the fullest extent permitted by law, the app is provided "as is" and "as available". We do not warrant that the app will be accurate, uninterrupted, error-free, or fit for any particular purpose. Nothing in these Terms limits warranties that cannot be excluded under the laws that apply to you, including consumer protection laws in the European Union and the United Kingdom. If the app does not conform with the subscription you bought, you have the remedies given by those laws.

10. Limitation of liability

To the fullest extent permitted by law:

• we are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits, or goodwill, arising from or related to the app;
• our total liability for all claims relating to the app in any 12-month period is limited to the amount you paid for the app in that period.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud, for intentional misconduct or gross negligence, or for any liability that cannot be excluded under the laws that apply to you. For consumers in the EU, the limits above apply only to the extent they are compatible with mandatory consumer law.

11. Apple as third-party beneficiary

The app is distributed through Apple's App Store. You acknowledge that:

• these Terms are between you and us, not Apple, and Apple is not responsible for the app or its content;
• Apple has no obligation to provide maintenance or support for the app;
• in the event of any failure of the app to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; to the maximum extent permitted by law Apple has no other warranty obligation;
• Apple is not responsible for addressing any claims by you or any third party relating to the app, including product liability, legal or regulatory compliance, or consumer protection claims;
• Apple is not responsible for the investigation, defence, settlement or discharge of any third-party intellectual property claim;
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

You represent that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. government list of prohibited or restricted parties.

12. Termination

You can stop using the app at any time by deleting it and cancelling your subscription. We may suspend or end your licence if you breach these Terms. On termination, the licence ends and you must delete the app. Sections that by their nature should survive (such as 9, 10, 11 and 14) survive termination.

13. Support and complaints

For support, write to hello@littleturns.app or visit https://littleturns.app/support. We aim to respond within five working days.

If you are an EU consumer and we cannot resolve a dispute, you may use the European Commission's online dispute resolution platform at https://ec.europa.eu/consumers/odr. We are not obliged to, and do not, take part in alternative dispute resolution proceedings before consumer arbitration boards unless the law requires it.

14. Governing law

These Terms are governed by the laws of Poland. If you are a consumer, you also benefit from the mandatory consumer protection provisions of the country where you live, and you may bring proceedings in the courts of that country. Otherwise, the courts of Poland have jurisdiction.

15. General

If any part of these Terms is found invalid, the rest remains in effect. Our failure to enforce a right is not a waiver of it. You may not transfer these Terms; we may transfer them to a successor who takes over the app, and will tell you if we do. These Terms, together with the Privacy Policy and Apple's EULA, are the entire agreement between you and us about the app.
